Summary of Legislation: This bill prohibits the State Board of Education from distributing Human
Immunodeficiency Virus literature to students without the consent of the governing body of the school
corporation the students attend. It requires instruction in state accredited schools on human sexuality or
sexually transmitted diseases to be based on information that is medically and scientifically accurate and age
appropriate. This bill also lists the criteria that instruction on human sexuality and sexually transmitted
diseases must meet.
Effective Date: Upon passage; July 1, 2021.
Explanation of State Expenditures: The Department of Education (DOE) must submit the results of annual
reports from state accredited schools (schools), regarding the curricula used to provide comprehensive sexual
health education, to the chairperson of the House Committee on Education and the chairperson of the Senate
Committee on Education and Career Development. This additional duty will result in a workload increase
for the DOE but may be completed using existing staff and resources.
Explanation of State Revenues:
Explanation of Local Expenditures: Schools must determine the appropriate age for sexual health
education and ensure the instructors and materials of any sexual health courses meet all requirements
outlined in this bill. Schools must also submit an annual report to the DOE regarding the curricula used to
provide comprehensive sexual health education. Additionally, schools must ensure that comprehensive sexual
health education is provided at least five times between grades 5-12 based on the following:
• Once in grade 5

• Twice total in grades 6-8
• Twice total in grades 9-12
Schools not already offering at least these minimum offerings of such courses will need to modify their
course offerings to satisfy this requirements. Schools will need to ensure the course materials and instructors
meet the requirements outlined in this bill. These additional duties will result in a workload increase for
schools. These duties fall within the routine administrative functions of schools and may be completed using
existing staff and resources.
The governing body of a school corporation must provide consent in order for the State Board of Education
to distribute Human Immunodeficiency Virus literature to a school corporation. This duty falls within the
routine administrative functions of the governing body of a school corporation and may be completed using
existing staff and resources.
