Summary of Legislation: (Amended) This bill requires hospitals to offer to administer an influenza
immunization to hospital patients who are 65 years of age or older and are discharged from the hospital from
October 1 through March 1, unless the immunization is contraindicated or is not available. The bill also
changes the date through which a health facility is required to administer or make available an influenza
immunization from February 1 to March 1.
Effective Date: July 1, 2021.
Explanation of State Expenditures: State Department of Health (ISDH) - The bill may result in an increase
in workload for ISDH to enforce compliance of the bill’s influenza immunization requirements for hospitals
and health facilities. Enforcing compliance with statutory requirements by regulated entities is generally
considered a routine administrative function. However, ISDH could incur additional costs and nonroutine
workload to the extent that consumer complaints increase.
State Health Care Plans - The bill could potentially result in a minor increase in claims for influenza
immunizations within populations covered by the state Medicaid plans or state employee health plans.
However, this impact is expected to be negligible as the vast majority of individuals affected by this bill are
likely to have federally funded Medicare coverage, or private insurance coverage in the case of health facility
employees.
Explanation of State Revenues: If violations regarding the bill’s requirements are committed by a hospital
or health facility, ISDH could potentially take an action that could impact General Fund revenue. If the
violator has a license denied or revoked, there would be a decrease in fee revenue to the General Fund.

Annual license fees range between $1,000 and $5,000 for hospitals, and at least $200 for health facilities.
ISDH may also impose a civil penalty of up to $10,000 for violations, which would be deposited in the
General Fund.
Explanation of Local Expenditures: County-Owned Facilities - County-owned hospitals and health
facilities could experience a small increase in workload and costs to comply with the bill’s requirements for
offering influenza immunizations.
