Summary of Legislation: This bill has the following provisions:
A. It requires the Department of Correction to adopt jail standards that prohibit a jail from housing a
child less than 18 years of age in the same cell as an adult, even if the child is charged as an adult
or has been convicted of an offense as an adult.
B. It specifies that a county jail may transfer a child if necessary to comply with the prohibition against
housing a child in the same cell as an adult.
Effective Date: July 1, 2021.
Explanation of State Expenditures: Jail Standards – DOC should be able to adopt new jail standards with
existing staff and resources.
Explanation of State Revenues:
Explanation of Local Expenditures: Transferring a Child – Sheriffs should be able to make these transfers
with existing resources.
Additional Information – The Criminal Justice Institute reported the following information about juveniles
who were in adult court jurisdiction between 2014 and 2018.
