Summary of Legislation: The bill provides that attendant care services include the use of lift equipment.
It requires a personal services agency that provides lift services to have liability insurance. The bill provides
that a client who receives attendant care services may decline assistance with any component of the attendant
care services. It also specifies that a client is not required to use lift equipment when lift services are
provided. The bill requires a personal services agency that offers lift services to train each employee who
provides those services, and it specifies that lift services are subject to the same evaluation and training
requirements as other attendant care service tasks.
Effective Date: July 1, 2021.
Explanation of State Expenditures: State Health Plans: If the addition of lift services increases the rates
charged by personal services agencies, the costs may put upward pressure on premiums for the state health
plans. Any impact is anticipated to be minimal. Costs for the state health plans are shared between the state
and state employees covered by the plan as determined in the plans’ designs, including premiums,
coinsurance, copayments, and deductibles. An increase in premiums cost may be mitigated with adjustments
to other benefits or to employee compensation packages, or through the division of premium costs between
the state and state employees.
Medicaid: Medicaid attendant services are available for individuals on the home and community based
services waiver and range between $1.81 and $5.82 for a 15-minute unit of service. For eligible enrollees,
the Medicaid fee schedule provides for $937 for a hydraulic patient lift and $2,718 for an electric patient lift,
or the lifts may be rented. It is indeterminate if the additional services will increase service fees or the

number of lifts purchased or rented for Medicaid enrollees.
Mitigation: Any added cost may be mitigated by fewer accidents or injuries for both the attendant and the
patient.
Indiana State Department of Health (ISDH): The ISDH may have increased workload related to oversight
of personal services agencies for the evaluation and training requirements of the bill.
Explanation of State Revenues: Disciplinary Action: If a personal services agency fails to provide to meet
the evaluation and training requirements for lift use, the State Health Commissioner could take disciplinary
actions that may impact General Fund revenue. The State Health Commissioner may impose a fine of up to
$1,000, which would be deposited in the state General Fund, or revoke or suspend the agency’s license.
License revocation or suspension would result in a decrease in revenue to the General Fund from license fees.
Professional services agency license fees are $250.
Premiums: If insurance plans experience increased cost due to lift services being added, it may put upward
pressure on premiums, which would increase the revenue to the state General Fund from either insurance
premium tax collections or Adjusted Gross Income (AGI) tax collections.
Explanation of Local Expenditures: The bill potentially impacts local units of government who offer
health insurance coverage for employees through a nonERISA plan. Added local health coverage costs may
be mitigated with adjustments to other benefits or to the total employee compensation packages, or through
the division of costs between the local unit and employees.
