Summary of Legislation: The bill prohibits a municipality from regulating design elements of residential
structures. It specifies certain exclusions from this prohibition. This bill also provides that any rule,
ordinance, or other regulation that conflicts with the prohibition is void. It provides that a person aggrieved
by a violation of the bill's provisions may file, in a court having jurisdiction, a petition to obtain an injunction
against the violation.
Effective Date: Upon passage.
Explanation of State Expenditures:
Explanation of State Revenues: Court Fee Revenue: A civil costs fee of $100 would be assessed when a
civil case is filed. If additional civil actions occur and court fees are collected, revenue to the state General
Fund may increase. A portion of the fee revenue is transferred to the Indiana Bar Foundation, and one fee
is deposited into the State User Fee Fund.
Additional fees may be collected at the discretion of the judge and depending upon the particular type of
case.
Explanation of Local Expenditures: If civil actions are filed against a municipality, local expenditures may
increase to pay for the cost of litigation and court fees. It is unknown how many civil actions for injunctive
relief will be filed and granted by the court. The specific impact would depend on local action.
Additional Information - The bill could reduce costs for future construction of Class 1 and Class 2 structures

and will impact local zoning.
Explanation of Local Revenues: Court Fee Revenue: If additional civil actions occur and court fees are
collected, local governments would receive additional revenue from both a portion of the civil costs fee and
other fees that would be collected.
