Summary of Legislation: The bill adds attempted murder to the offenses that may be enhanced if a person
used a firearm in commission of the offense.
Effective Date: July 1, 2021.
Explanation of State Expenditures: Summary– This provision could increase the Department of Correction
(DOC) facility populations if more persons using a firearm in the commission of attempted murder are
convicted of attempted murder and receive an enhanced sentence. Additional sentencing would be between
5-20 years. From CY 2013 through CY 2019, there were, on average, 33 attempted murder convictions per
year. The number of those committed with a firearm is unknown, but could possibly be as high as 68%
according to FBI statistics.
Additional Information– Attempted murder is a Level 1 felony, which is punishable by a prison term ranging
from 20 to 40 years, with an advisory sentence of 30 years. The average expenditure to house an adult
offender was $21,551 annually ($59 daily) in FY 2020. (This does not include the cost of new construction.)
If offenders can be housed in existing facilities with no additional staff, the marginal cost for medical care,
food, and clothing is approximately $3,524 annually, or $9.66 daily, per prisoner.
Level 1 felons must be sentenced to a minimum 20 years in prison before eligibility for sentence suspension
and placement on probation or community corrections. If no time is suspended, then offenders can receive
good time credit of 25% and educational credit time. Upon release, offenders can be placed on parole.
