Summary of Legislation: (Amended) The bill provides that candidates for United States Senate and
Governor nominated by a political party other than a major political party at a convention must obtain and
file their petitions at the same time as candidates nominated for these offices at a primary election.
Effective Date: July 1, 2021.
Explanation of State Expenditures: (Revised) Currently, a political party whose nominee for Secretary of
State receives at least 2% but less than 10% of the votes at the most recent election for that office may
nominate candidates for United States Senator and Governor at a state convention (rather than a primary
election). The bill would require a petition with at least 4,500 signatures, including 500 from each
congressional district for a candidate to be eligible for nomination. After county voter registration offices
certify petitions, the petitions are filed with the Indiana Election Division which counts the number of
signatures. The Indiana Election Commission reviews the forms if a challenge is filed. The bill could increase
workload in regard to petitions for Libertarian candidates. [See Explanation of Local Expenditures.]
Explanation of State Revenues:
Explanation of Local Expenditures: (Revised) The bill would have an indeterminate impact on the
workload of county voter registration offices and will depend on the number of Libertarian candidates for
Governor and United States Senator, which are not currently required to have petitions signed. County voter
registration offices must certify whether each person who signs the petition is a registered voter at the
residence listed in the petition.

Currently the Libertarian party is the only party whose candidates do not have to submit petitions with
signatures as it is not required for parties that receive at least 2% but less than 10% of the votes at the most
recent election for Secretary of State. [The Libertarian Party received 3.2% of the votes for the 2018
Secretary of State election.]
Additional Information: Republican and Democratic candidates for Governor or United States Senator must
already file declarations of candidacy with the Secretary of State accompanied by a petition with this number
of signatures. Independent and other minor party candidates’ petitions for Governor and United States
Senator are required to have roughly 45,000 signatures (2% of the total vote for Secretary of State at the last
election).
