Summary of Legislation: This bill provides that a person assigned to credit class P earns one day of good
time credit for each day served.
Effective Date: July 1, 2021.
Explanation of State Expenditures: This bill would reduce the length of stay of persons who were placed
on pretrial home detention and then, after trial, committed to DOC facilities.
Persons in Class P are on home detention and awaiting trial. (IC 35-50-6-4 (I)). Currently they receive one
day good time credit for every four days that they are on home detention awaiting trial. As proposed, these
persons would receive more credit time for earlier release from two sources: First, the current good time
credit of one day credit for every four days in home detention would be changed to one day good time credit
for every one day served. In addition, this bill strikes the prohibition of accrued time that would be added
into total credit time as well for Class P offenders (IC 35-50-6-0.5 (2). (See Additional Information.)
DOC reports an average daily pretrial population of 3,175 in November 2020 that were being supervised
in community corrections agencies. Since information on the felony level charged and post trial sentences
was not available for persons who were on home detention, OFMA cannot estimate how much their length
of stay could be reduced and what possible reduction in DOC’s population could occur.

Additional Information – “Credit time" means the sum of a person's accrued time, good time credit, and
educational credit (IC 35-50-6-0.5). As proposed, persons who were placed on pretrial home detention could
also receive “accrued time” as well. "Accrued time" means the amount of time for which a person is
imprisoned or confined. "Good time credit" means a reduction in a person's term of imprisonment or
confinement awarded for the person's good behavior while imprisoned or confined.
