Summary of Legislation: This bill permits, under certain circumstances, an offender committed to the
Department of Correction (DOC) to be held within a treatment facility operated by the DOC for not more
than 14 days beyond the offender's mandatory release date if: (1) the offender consents; or (2) a court has
ordered the offender to be committed to a treatment setting outside the DOC.
Effective Date: July 1, 2021.
Explanation of State Expenditures: Minor Increase in DOC Expenditures – If offenders consent or the
sentencing court orders, they can remain confined in DOC facilities for not more than 14 more days if DOC
is experiencing problems in securing proper transitional care or post confinement treatment. While all
releases are planned, DOC reports occasionally finding difficulty securing proper facilities or family care
for offenders with serious physical and/or mental disabilities when a facility or family members are no longer
able or willing to receive the offender.
Since these offenders would be housed in existing facilities with no additional staff, the marginal cost for
medical care, food, and clothing is estimated at $9.66 per day, per prisoner. These marginal cost estimates
are based on contractual agreements with food and medical vendors and projections based on prior years for
clothing and hygiene.
