STATEMENT OF PURPOSE
RS29777 / S1397
Temporary rules do not follow the negotiated rulemaking process and lack transparency and accountability.
This legislation ensures agencies make every effort to promulgate rules utilizing the negotiated rulemaking
process instead of temporary rulemaking and may only use temporary rulemaking in emergency situations. The
legislation achieves the goals of Article III, Section 29 of ensuring legislative oversight of all administrative
rules by prohibiting any temporary rule that is not approved by the legislature in the following legislative session
from being repromulgated without going through the negotiated rulemaking process.
FISCAL NOTE
This legislation will have no impact on the general fund because it deals only with the temporary administrative
rules process.
