STATEMENT OF PURPOSE

This bill updates Chapter 66, Title 18, Idaho Code. It amends the crime of Incest to modernize terminology
and make consistent with other statutes what sexual conduct is prohibited. It removes unenforceable offenses
of Adultery and Fornication. It repeals the Infamous Crime Against Nature, which is an antiquated and unclear
statute that relies on judge-made law to determine what is a violation of the statute rather than stating expressly
in code what is and is not a violation. This bill adds two offenses which criminalize behavior which was clearly
prohibited by the Infamous Crime Against Nature: (1) Sexual Abuse of an Animal and (2) Sexual Abuse of
Human Remains. It also amends the Forcible Penetration to apply to a scenario where a perpetrator forces
another to penetrate a third party. The rest of the bill corrects references throughout the code stemming from
the changes within Chapter 66.
FISCAL NOTE
This change will have no fiscal impact to state or local government because it does not legalize or criminalize
behavior that is legally enforceable by other offenses in code.
