STATEMENT OF PURPOSE
RS28561 / S1113
The purpose of this legislation is to clarify Idaho Transportation Department stopping and inspection authority
at check stations (ports of entry, weigh stations, and temporary check stations) as required in Idaho code 40-511.
Currently, non-commercial vehicles above 26,000 lbs. gross weight are not required to stop at any of the above
listed stations. For example, a Class A motorhome is not required to stop even if above the weight limit.
Vehicles with a maximum gross weight greater than 10,000 lbs. and transporting livestock are required to stop
at any check station. A distinction is not made between commercial and non-commercial activity. This means
that a pickup with horse trailer going to a trailhead for a recreational trail ride should be pulling in at all check
stations. The bill clarifies that non-commercial vehicles are not required to stop at check stations.
FISCAL NOTE
This legislative proposal represents no fiscal impact on the Idaho State General Fund nor any other governmental
entity. No dollars are used for defining stopping and inspection authority at check stations.
