STATEMENT OF PURPOSE

The purpose of this bill is to repeal a portion of Idaho law that provides exceptions to the criminal definition
of rape based on the relationship of the parties, which is unnecessary as it is not used by prosecutors. This bill
updates Idaho law to define rape the same regardless of who is involved, by repealing in its entirety Section
18-6107, Idaho Code, Spousal Rape. This bill also amends the state’s definition of rape to ensure that those
legally married to persons aged 16 and 17 cannot be charged with statutory rape.
FISCAL NOTE
The legislation repeals a portion of Idaho Code providing exceptions to rape. The legislation does not mandate
any appropriations and does not mandate any future increase in appropriations. The legislation will not impact
the general fund or any dedicated fund.
