Consistent with the Governor's Red Tape Reduction Act, this bill seeks to eliminate inactive provisions of law.
This legislation eliminates two obsolete parts of Idaho Code.
The first part eliminates the outdated practice of requiring drivers to surrender their driver’s license to the
Department or law enforcement when their driving privileges are temporarily withdrawn due to suspension
or revocation. A driver’s record with the Department clearly indicates the real-time status of an individual’s
driving privileges to law enforcement; and many driving privilege withdrawals are short in duration, rendering
the practice of surrendering the physical driver’s license obsolete and unnecessarily burdensome for drivers.
Additionally, one’s driver’s license is the main source of identification for many uses such as: banking, traveling
and public services.
This legislation also repeals section 49-2501, Idaho Code relating to the Non-Resident Violator Compact
(NRVC). The NRVC is a reciprocal agreement among states to ensure payment of citations when a non-resident
motorist commits an offense in a state and returns to their home state without paying the associated fine. Under
the NRVC, the citing state could request that the home state suspend a driver’s license until the outstanding
fine is paid. In 2018, House Bill 599 repealed section 49-1505, Idaho Code, and eliminated the Department’s
authority to suspend driver licenses/privileges for unpaid infractions. As a result, Idaho is no longer able to
comply with the NRVC, thus the reason to remove it from Idaho Code. Leaving this code section intact causes
confusion with other jurisdictions regarding whether or not Idaho is still a participating state.
FISCAL NOTE
There is no expected fiscal impact from the Nonresident Violator Compact portion of this legislation, because
the legislation simply codifies current practices.
There will be very minimal impact to the Department's dedicated funds for the license surrender portion of the
legislation. License surrenders are a rare occurrence, with the department receiving less than a few hundred
each year. Surrenders based on suspensions compose a small percentage of those surrenders. These licensees
will no longer have to pay for a duplicate license.
