STATEMENT OF PURPOSE

Last year, the Idaho Legislature passed S.B. 1284 brought by the Public Defense Commission (PDC) which
added to the PDC's public records exemptions. See Section 74-105(18). LSO added to the PDC's proposed
legislation a change in Section 74-105(5), changing the application of that exemption from the Sexual Offender
Classification Board (SOCB) to the Sexual Offender Management Board (SOMB). The SOCB no longer exists
and was a separate from the SOMB However, the SOMB retains the SOCB's records.
This bill restores back the exemption for certain records of the SOCB in Section 74-105(5). It also adds to the
duties of the SOMB in Section 18-8314 the obligation to retain the records for the former SOCB.
FISCAL NOTE
No anticipated fiscal impact related to the change in duties from SOCB to SOMB.
