STATEMENT OF PURPOSE

Consistent with the Governor's Red Tape Reduction Act, this bill seeks to eliminate inactive provisions of law.
DEQ is proposing to repeal Idaho Code 37-2102, Domestic Water to be Protected, which is in Chapter 21,
Domestic Water and Ice. Idaho Code 37-2102 is not being used by either DEQ or the Department of Health
and Welfare for regulating drinking water or domestic ice. This section contains language that conflicts with
the Idaho Rules for Public Drinking Water Systems, IDAPA 58.01.08, regarding public notification.
Public water systems are covered under the Idaho Environmental Protection and Health Act, Idaho Code
sections 39-105, 108, 109, 116, 116A, and 118. Domestic ice is covered in Idaho Code 37-2101. As part of the
Governor's efforts to reduce red tape, this legislative idea seeks to eliminate outdated, obsolete, or unnecessary
provisions within Idaho Code.
FISCAL NOTE
There are no anticipated fiscal impacts for repealing this section of the statute.
