STATEMENT OF PURPOSE

This legislation transfers the responsibilities for the health care directive registry from the Secretary of State to
the Department of Health and Welfare, including the existing records, and directs the Department to make the
registry available 24-hours-a-day, seven days a week.
FISCAL NOTE
The cost to design, build, and implement an interoperable advanced care directive database system in the
Department of Health and Welfare is estimated to be $351,300 one-time. The design and buildout can be funded
at a 90% federal share using HITECH funds and 10% state match. Personnel costs to operate the registry and
on-going software licenses/maintenance fees may also use federal matching dollars and state funds for on-going
expenses at a 75/25 fund split.

Once operational, the Department will determine if a fee – already allowed in statute – will be assessed in order
to provide standardized enrollment materials and statewide training for providers to help Idahoans include their
directives in the statewide registry.
