STATEMENT OF PURPOSE

The purpose of this legislation is to allow citizens to petition the Attorney General to investigate alleged
violations of Idaho's open meeting law when the county prosecuting attorney fails to take action. If the A.G.
determines that probable cause of a violation exists, he shall refer it back to the prosecuting attorney. If the
prosecuting attorney still takes no action, the A.G., at his discretion, may pursue nonjudicial remedies.
FISCAL NOTE
The Attorney General's office estimates that this responsibility may require an additional deputy attorney
general and a paralegal, resulting in a fiscal impact to the General Fund of $204,300 for the year ended June
30, 2021, and $153,600 each year thereafter. There may be additional costs to some county prosecuting
attorney offices, however, this legislation does not expand their current duties and obligations.
