STATEMENT OF PURPOSE
RS27713 / S1342
Burglary is a felony and involves someone entering certain places like your home or business with the intent to
commit theft or a felony. There are instances where someone who enters a store to commit shoplifting of items
of minor value could be guilty of felony burglary. This is an effort to recognize that such instances are more
appropriately handled as a misdemeanor rather than a felony.
FISCAL NOTE
There should be no significant fiscal impact. There is the potential for cost savings if these cases proceed as
misdemeanors in Magistrate court instead of the more lengthy felony court proceedings in District court.
