STATEMENT OF PURPOSE

This legislation is necessary to reverse legislation passed in the 2019 session which permitted warrantless arrests
for certain misdemeanors. In June 2019, the Idaho Supreme Court ruled in State v. Clarke, 135 Idaho 255, 16
P.3d 931 (2019) that warrantless misfeasor arrests are unconstitutional unless the alleged crime is witnessed by
a law enforcement officer.
FISCAL NOTE
This legislation will have no fiscal impact on the State General Fund because the bill does not require
expenditure of funds. It may have an impact on local law enforcement costs, but are unknown because it
depends on the unknown acts of others.
