STATEMENT OF PURPOSE

The Commission of Pardons and Parole is required by Article IV, Section 7 to file pardons, commutations, and
remissions of fines and forfeitures with the Secretary of State. This legislations requires the commission to give
an original copy of the pardon, commutation, or remission of fines and forfeitures document to the petitioner as
well as retain an original copy at the commission. This practice will now be codified, but it has already been the
practice of the commission to do this. Additionally, this legislation requires the commission to file an original
copy of those documents with the state courts so that it is more easily known that the petitioner has received a
pardon, commutation, or had fines and forfeitures remitted.
FISCAL NOTE
Approximately 20 to 40 pardons a year are granted. Commutations and remissions of fines and forfeitures
are historically very rarely granted. In a normal year with 40 pardons, the only additional cost incurred by
the commission to comply with this legislation is approximately $20 (40 additional sheets of paper and 40
additional gold seals affixed to the paper, all of which will be filed with the court). The de minimis additional
cost to comply with this legislation will be absorbed by the commission.
