STATEMENT OF PURPOSE

This legislation clarifies that a solicitation of bids for portions of work under a CM/GC must follow public notice
requirements. The legislation clarifies all contracts for Construction Management must include a guaranteed
maximum price (GMP) at the time of contract. Additionally, this legislation clarifies and distinguishes the
difference between professional advisement services provided by a Construction Management Representative
(CMR) as separate from construction for fee services provided by a Construction Manager General Contractor
(CM/GC).
FISCAL NOTE
Increased accountability fosters conscientious spending on costs managed by a Construction Manager.
Requiring a Guaranteed Maximum Price alleviates cost over run risk to taxpayers. Local governments will
enjoy lower, more competitive costs for public works projects managed by a Construction Manager. They will
also benefit from the ability to have known budgeted costs up-front. No direct impact to revenues.
