STATEMENT OF PURPOSE

This legislation amends Section 39-906 of Idaho Code and repeals Section 39-908 titled "Penalty for Violation"
and Section 39-911 titled "Violations – Penalty." These sections of code make it a misdemeanor offense if
newborn screening data is not provided to the state. This change removes the penalties thus decriminalize
parents who birth their children at home and choose not to supply the state with newborn screening data.
FISCAL NOTE
There is no fiscal impact to the general fund or local governments because it reduces legislative requirements.
