STATEMENT OF PURPOSE

This bill to eliminate marriage licensing retains marriage solemnization and recording of a marriage certificate
with the county recorder, where the fee is paid to record the certificate. By publicly recording a solemnized
marriage, there will continue to be a public, legal record of the marriage, and the recorded certificate is the legal
proof of the marriage.
FISCAL NOTE
There will be a $205,755 estimated negative fiscal impact to the State Domestic Violence Project fund. An
identical amount from the general fund would be necessary to hold the fund harmless.
This legislation requires no action from the state other than regular implementation of change of Idaho Code.
There will be no requirements of enforcement, or other action necessary to be taken by State agencies or local
government agencies.
There will be an estimated $205,755 positive fiscal impact to counties domestic violence programs statewide.
