STATEMENT OF PURPOSE
RS27487 / H0428
This legislation defines the term "willful or reckless misconduct," as used in Idaho Code Title 6, Chapter 16. A
recent Idaho Supreme Court case noted the absence of a definition, which has caused uncertainty concerning
the proper definition. Defining the term is important in order to bring clarity to Idaho liability laws.
FISCAL NOTE
There is no fiscal impact because the legislation merely adds a definition to clarify law and does not involve
the expenditure of funds, nor the collection of revenue.
