STATEMENT OF PURPOSE

This proposal seeks to do two keys things, remove obsolete restrictions and distribute fees to the entity providing
the service.
Consistent with the Red Tape Reduction Act and the Licensing Freedom Act, this proposal seeks to eliminate
obsolete and unnecessary restrictions. Specifically, this proposal removes unnecessary requirements on
automobile salesmen license renewals. Repealing code 49-1635 is in line with the Governor's executive
orders. Although code refers to minimum sales as a part of salesman licensing renewals, this law provides no
value to the licensing process, and is not a regulation that is relied on as a basis for determining renewals. The
department believes that repealing section 49-1635 is in the best interest of the licensed salesmen by removing
irrelevant regulations.
Additionally, this proposal seeks to distribute fees for Dealer and Salespeople identification cards to the entity
that provides the service. This change will allow licensed individuals to opt into receiving their identification
card directly from the department as part of their application instead of needing to take time away from their
business to go a physical DMV location to obtain this ID.
This initiative has the support of industry and the Dealer Advisory Board, as it has been an idea that has been
discussed as a means to clean-up unnecessary codes that provide no value to the industry.
FISCAL NOTE
There is no expected fiscal impact to the department, industry or customers, because there is no anticipated
change in processes and the proposal aligns with current business practices. Additionally this proposal does
not add or change any of the fees currently assessed.
