STATEMENT OF PURPOSE

Consistent with the Red Tape Reduction Act, this bill seeks to eliminate obsolete and unnecessary restrictions.
Specifically, the Idaho State Department of Agriculture (ISDA) proposes amending three sections of Idaho
Code: 22-103(21), which prescribes Duties of the Director; 22-608 of the "Idaho Fertilizer Act of 2000"; and
22-2208 of the "Soil and Plant Amendment Act of 2001."
The bill removes the requirement for the ISDA to set late payment interest rates in rule. The rate is established
in Idaho Code and an additional rule is unnecessary.
The bill also replaces semiannual tonnage reporting with annual reporting for both fertilizers as well as soil and
plant amendments.
FISCAL NOTE
The changes to 22-103(21) also have no fiscal impact on the ISDA or the General Fund as it simply removes a
redundancy. It would not affect the agency's ability to assess interest to late accounts.
Changes to 22-608 and 22-2208 may save Idaho businesses money as they will not be required to submit
multiple reports to the ISDA. The amendments would have no fiscal impact on the ISDA or the General Fund,
as they would not change fertilizer or soil and plant amendment program fee structures.
