STATEMENT OF PURPOSE
RS26638
This legislation entitles the prevailing party, in an administrative procedure between a licensee and a
licensing authority, to recover reasonable investigative and defense costs. The assessment of fees in such
proceedings will be subject to judicial review if judicial review is requested.
FISCAL NOTE
The following state agencies, among others, could be affected by this legislation and may require additional
appropriation to cover any legal fees required, but those amounts are unknown at this time: the Idaho
Transportation Department, the Department of Insurance, the Department of Finance, the Department of
Health and Welfare, the Racing Commission, the Department of Agriculture, the Idaho State Police, the
Department of Corrections, the Department of Water Resources, the Department of Lands, the Idaho State
Tax Commission, and the Department of Fish and Game. The fiscal impact of this legislation will vary by
agency and the amounts would be determined on a case by case basis.
