STATEMENT OF PURPOSE

Section 18-8601 amends the legislative intent to acknowledge the presence of human trafficking cases in
Idaho and the importance of the law enforcement community receiving the necessary training to increase
awareness and response to human trafficking cases. Section 18-8602 adds language identifying conduct that
may be considered labor trafficking and further defining "force, fraud or coercion." The language is intended
to provide guidance to law enforcement and prosecution for the types of conduct that may be considered
human trafficking under Idaho law. Section 18-8603 removes language requiring the crime be committed
in conjunction with the commission of another crime defined in section 18-8602, thereby making human
trafficking an independent criminal offense rather than an enhancement to another criminal offense. Section
18-8605 is to be removed entirely as it calls for a one-time report completed by identified agencies on or
before July 1, 2007.
FISCAL NOTE
It is possible that previously uncharged conduct could result in an increase in criminal cases filed creating a
fiscal impact on the county court systems. Much of this conduct is currently charged under other statutes or
is amended, so the overall impact would likely be minimal.
