STATEMENT OF PURPOSE

In St. Alphonsus Regional Medical Center v. Raney, 163 Idaho 342 (2018), the Idaho Supreme Court ruled
that counties are, in some cases, responsible for payment of the continuing medical bills of inmates after they
have been released from the sheriff's custody. Prior to this decision, the Sheriff (and therefore the County)
only had the duty to pay for medical expenses of an inmate while the inmate was actually in the sheriff's
custody. This proposed legislation would limit the sheriff's duty to provide medical care to those inmates in
the sheriff's custody, and then only for the duration of their incarceration.
FISCAL NOTE
This bill will result in reduced jail medical expenses for counties.
