STATEMENT OF PURPOSE
RS26874
This legislation makes a technical correction to address a lack of clarity in current code.
State law allows local governmental entities to make sole-source purchases under limited circumstances,
such as there being only one available vendor or there being only one available product or purchasing
mass-produced materials.
However, since the relevant code is in the same section as other requirements for emergency purchases, it
gives the mistaken impression that an emergency must be declared by a governing board or council before
a sole-source purchase can be made.
This law amends state code to clarify that an emergency is not required to make a sole-source purchase as
long as the local governmental entity meets the other requirements for a sole-source purchase.
FISCAL NOTE
Since this legislation is focused on cities, counties, and school districts, there should be no impact on the
state general fund. It further should not impact state or local funds, as it is a technical correction.
