1 An Act relating to provision of the state family planning
2 services under the Medicaid program, and including effective
3 date and repeal provisions.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 DIVISION I
2 IOWA FAMILY PLANNING NETWORK —— MEDICAID STATE PLAN AMENDMENT
3 Section 1. IOWA FAMILY PLANNING NETWORK —— MEDICAID STATE
4 PLAN AMENDMENT. The department of health and human services
5 shall submit a Medicaid state plan amendment to the centers for
6 Medicare and Medicaid services of the United States department
7 of health and human services for approval to establish the Iowa
8 family planning network with the same benefits, eligibility
9 requirements, and other provisions included in the Medicaid
10 Iowa family planning network waiver as approved by the centers
11 for Medicare and Medicaid services of the United States
12 department of health and human services in effect on June 30,
13 2017.
14 Sec. 2. EFFECTIVE DATE. This division of this Act, being
15 deemed of immediate importance, takes effect upon enactment.
16 DIVISION II
17 REPEAL OF STATE FAMILY PLANNING SERVICES PROGRAM
18 Sec. 3. REPEAL. Section 217.41B, Code 2023, is repealed.
19 Sec. 4. CONTINGENT EFFECTIVE DATE. The following takes
20 effect upon receipt of approval by the department of health
21 and human services from the centers for Medicare and Medicaid
22 services of the United States department of health and human
23 services of the Medicaid state plan amendment submitted
24 pursuant to division I of this Act to establish the Iowa family
25 planning network:
26 The section of this division of this Act repealing section
27 217.41B, Code 2023.
28 EXPLANATION
29 The inclusion of this explanation does not constitute agreement with
30 the explanation’s substance by the members of the general assembly.
31 This bill relates to state family planning services.
32 Division I of the bill requires the department of health and
33 human services (HHS) to submit a Medicaid state plan amendment
34 to the centers for Medicare and Medicaid services of the United
35 States department of health and human services (CMS) for

1 approval to establish the Iowa family planning network with the
2 same benefits, eligibility requirements, and other provisions
3 included in the Medicaid Iowa family planning network waiver
4 as approved by CMS in effect on June 30, 2017. The section of
5 division I of the bill requiring submission of the state plan
6 amendment takes effect upon enactment.
7 Division II of the bill repeals the state family planning
8 services program. The repeal of the program takes effect upon
9 receipt of approval by HHS from CMS of the Medicaid state plan
10 amendment establishing the Iowa family planning network.
