1 An Act relating to the sale of water to recipients outside the
2 state, and making penalties applicable.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 455B.280 Sale of water to
2 recipients outside the state —— report.
3 1. For purposes of this section, “entity” includes a public
4 utility including but not limited to a county water system or a
5 rural water system.
6 2. By January 31 of each year, an entity that sells water
7 withdrawn in this state to a recipient outside the state shall
8 submit to the department a report detailing the origin of
9 the water extracted within the state, the identity of each
10 out-of-state recipient, the purpose of each out-of-state
11 recipient’s water usage, and the amount of water in gallons
12 that the entity withdrew in this state and sold to a recipient
13 in the previous calendar year. The department shall make the
14 reports publicly accessible on the department’s internet site.

16 The inclusion of this explanation does not constitute agreement with
17 the explanation’s substance by the members of the general assembly.
18 This bill relates to the sale of water to a recipient outside
19 the state. The bill requires an entity, as defined in the
20 bill, that sells water withdrawn in this state to a recipient
21 outside the state to submit to the department of natural
22 resources (DNR), by January 31 of each year, a report detailing
23 the origin of the water extracted within the state, the
24 identity of each out-of-state recipient, the purpose of each
25 out-of-state recipient’s water usage, and the amount of water
26 in gallons that the entity withdrew in this state and sold to a
27 recipient in the previous calendar year. DNR shall make the
28 reports publicly accessible on the department’s internet site.
29 By operation of law, a person who violates the bill is subject
30 to civil enforcement, which may include a civil penalty not to
31 exceed $500 for each day a violation occurs.
