2 providers of certain substance use disorder treatment
3 services.

1 Section 1. SUBSTANCE USE DISORDER TREATMENT SERVICES
2 PROVIDERS —— REIMBURSEMENT RATES. The department of health and
3 human services shall establish a rate structure for Medicaid
4 1915(b)(3) waiver reimbursement, applicable under Medicaid
5 managed care organization administration, for substance
6 use disorder residential and intensive outpatient treatment
7 services providers that are licensed by the state to deliver
8 Medicaid 1915(b)(3) services. The department shall establish
9 time frames for release of the rate structure to providers
10 and the deadline for submission of the completed projected
11 cost reports by providers to the department in order to allow
12 sufficient time for review and the making of recommended
13 adjustments to the Medicaid 1915(b)(3) waiver reimbursement
14 rates for Medicaid providers. The department of health and
15 human services shall establish a plan for regular review of
16 reimbursement rates for providers of substance use disorder
17 treatment services and shall provide information to the
18 governor and the general assembly in a timely manner to allow
19 for the provision of appropriate funding for any change in
20 reimbursement rates.
21 EXPLANATION
22 The inclusion of this explanation does not constitute agreement with
23 the explanation’s substance by the members of the general assembly.
24 This bill directs the department of health and human
25 services (the department) to establish Medicaid 1915(b)(3)
26 waiver reimbursement rates, applicable to providers under
27 Medicaid managed care administration, for substance use
28 disorder residential and intensive outpatient treatment
29 services providers that are licensed by the state to deliver
30 1915(b)(3) services. The department shall establish time
31 frames for release of the rate structure to providers and
32 the deadline for submission of the completed projected cost
33 reports by providers to the departments, to allow sufficient
34 time for review and the making of recommended adjustments to
35 the reimbursement rates. The department shall establish a plan
