AN ACT
RELATING TO IOWA UTILITIES BOARD REVIEW OF SPECIFIED PROVISIONS
AND UTILITY RATEMAKING PROCEDURES.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. IOWA UTILITIES BOARD REVIEW.
2 1. The utilities board shall initiate and coordinate
3 an independent review of current Iowa Code provisions and
4 ratemaking procedures. The review shall take into account
5 the policy objectives of ensuring safe, adequate, reliable,
6 and affordable utility services provided at rates that are
7 nondiscriminatory, just, reasonable, and based on the utility’s
8 cost of providing service to its customers within the state.
9 The review shall include all of the following:
10 a. An evaluation of the adequacy of current ratemaking law
11 and procedure to promote the policy objectives described in
12 this subsection.
13 b. Identification of possible changes in law or procedure
14 that might better advance the policy objectives described in
15 this subsection.
16 c. Recommendations for changes in law and administrative
17 rules.
18 d. Identification of ratemaking laws and procedures of
19 other states that, if adopted in Iowa, could enhance the
20 competitiveness of utility rates in Iowa as compared with
21 utility rates in other jurisdictions.

22 2. The consumer advocate division of the department
23 of justice shall, and rate-regulated utilities and other
24 interested persons may, participate in the review. The board
25 may utilize additional services to assist in the coordination
26 of the review and preparation of the report. The board shall
27 submit a report with findings and recommendations to the
28 general assembly by January 1, 2024.
