1 An Act relating to access to criminal history data in child in
2 need of assistance proceedings.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 692.1, subsection 7, Code 2023, is
2 amended to read as follows:
3 7. “Criminal or juvenile justice agency” means an either of
4 the following:
5 a. An agency or department of any level of government
6 or an entity wholly owned, financed, or controlled by one
7 or more such agencies or departments which performs as its
8 principal function the apprehension, prosecution, adjudication,
9 incarceration, or rehabilitation of criminal or juvenile
10 offenders.
11 b. The department of health and human services and agents
12 and employees of the department of health and human services,
13 including county attorneys and assistant county attorneys,
14 who have been appointed by a juvenile court to represent
15 the department of health and human services in a proceeding
16 alleging that a child is a child in need of assistance as
17 defined in section 232.2.
18 EXPLANATION
19 The inclusion of this explanation does not constitute agreement with
20 the explanation’s substance by the members of the general assembly.
21 This bill relates to access to criminal history and
22 intelligence data in child in need of assistance proceedings.
23 The bill adds to the definition of “criminal or juvenile
24 justice agency” (relating to the provision of criminal history
25 and intelligence data under Code chapter 692) the department of
26 health and human services (HHS) and HHS agents and employees,
27 including county attorneys and assistant county attorneys,
28 who have been appointed by a juvenile court to represent HHS
29 in a proceeding alleging that a child is a child in need of
30 assistance.
31 For the purposes of Code chapter 692, “criminal history
32 data” means any or all of the following information maintained
33 by the department of public safety or the division of criminal
34 investigation of the department of public safety in a manual or
35 automated data storage system that is individually identified:

1 arrest data, conviction data, disposition data, correctional
2 data, adjudication data, and custody data; and “intelligence
3 data” means information on identifiable individuals compiled in
4 an effort to anticipate, prevent, or monitor possible criminal
5 activity.
