1 An Act relating to county or city legislation affecting dog
2 ownership.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 331.301, Code 2023, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 22. A county shall not adopt, enforce,
4 or otherwise administer an ordinance, motion, resolution, or
5 amendment that restricts or hinders a person’s right to own or
6 keep a dog based on the breed or perceived breed of the dog.
7 This subsection does not inhibit the authority of a county to
8 adopt, enforce, or administer an ordinance, motion, resolution,
9 or amendment that applies to all dogs.
10 Sec. 2. Section 364.3, Code 2023, is amended by adding the
11 following new subsection:
12 NEW SUBSECTION. 18. A city shall not adopt, enforce, or
13 otherwise administer an ordinance, motion, resolution, or
14 amendment that restricts or hinders a person’s right to own or
15 keep a dog based on the breed or perceived breed of the dog.
16 This subsection does not inhibit the authority of a city to
17 adopt, enforce, or administer an ordinance, motion, resolution,
18 or amendment that applies to all dogs.
19 EXPLANATION
20 The inclusion of this explanation does not constitute agreement with
21 the explanation’s substance by the members of the general assembly.
22 This bill prohibits counties and cities from adopting,
23 enforcing, or administering an ordinance, motion, resolution,
24 or amendment that restricts or hinders a person’s right to own
25 or keep a dog based on the breed or perceived breed of the dog.
26 The bill does not inhibit the authority of a county or city to
27 adopt, enforce, or administer an ordinance, motion, resolution,
28 or amendment that applies to all dogs.
