1 An Act relating to the inspection of a private sewage disposal
2 system for certain transactions.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 455B.172, subsection 11, paragraph
2 a, Code 2023, is amended by adding the following new
3 subparagraphs:
4 NEW SUBPARAGRAPH. (13) A change in the business entity
5 owning the property if such change results in the same
6 persons or immediate family members of such persons owning
7 the property. For purposes of this subparagraph, “immediate
8 family member” means a spouse, child, stepchild, brother,
9 brother-in-law, stepbrother, sister, sister-in-law, stepsister,
10 parent, parent-in-law, or stepparent.
11 NEW SUBPARAGRAPH. (14) The subdivision of a property that
12 was previously held jointly.
13 EXPLANATION
14 The inclusion of this explanation does not constitute agreement with
15 the explanation’s substance by the members of the general assembly.
16 This bill relates to the inspection of a private sewage
17 disposal system for certain transactions. Under current law,
18 if a building where a person resides, congregates, or is
19 employed is served by a private sewage disposal system, the
20 sewage disposal system serving the building shall be inspected
21 prior to any transfer of ownership of the building. The bill
22 provides two exceptions to the definition of “transfer”. Under
23 the bill, a transfer does not include a change in the business
24 entity owning the property if such change results in the same
25 persons or immediate family members of such persons owning the
26 property, nor does a transfer include the subdivision of a
27 property that was previously held jointly.
