1 An Act relating to required considerations by a county
2 compensation board.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 331.907, subsection 1, Code 2023, is
2 amended to read as follows:
3 1. The annual compensation of the auditor, treasurer,
4 recorder, sheriff, county attorney, and supervisors shall
5 be determined as provided in this section. The county
6 compensation board annually shall review the compensation
7 paid to comparable officers in other counties of this
8 state, other states, private enterprise, and the federal
9 government, and shall consider the current economic health
10 of the county, state, and country. In setting the salary of
11 the county sheriff, the county compensation board shall set
12 the sheriff’s salary so that it is comparable to salaries
13 paid to professional law enforcement administrators and
14 command officers of the state patrol, the division of criminal
15 investigation of the department of public safety, and city
16 police chiefs employed by cities of similar population to
17 the population of the county. The county compensation board
18 shall prepare a compensation schedule for the elective elected
19 county officers for the succeeding fiscal year. The county
20 compensation board shall provide documentation to the board of
21 supervisors that demonstrates how the county compensation board
22 determined the recommended compensation schedule, including
23 by providing the applicable compensation information for all
24 the adjacent counties in this state and for counties in this
25 state with a similar population. A recommended compensation
26 schedule requires a majority vote of the membership of the
27 county compensation board.
28 EXPLANATION
29 The inclusion of this explanation does not constitute agreement with
30 the explanation’s substance by the members of the general assembly.
31 This bill relates to the duties of a county compensation
32 board when recommending a compensation schedule. Under current
33 law, a county compensation board recommends a compensation
34 schedule for elected county officers for the succeeding fiscal
35 year and submits the recommended compensation schedule to the

1 county board of supervisors for approval. When determining
2 the recommended compensation schedule, current law requires
3 the county compensation board to review the compensation paid
4 to comparable officers in other counties of this state, other
5 states, in private enterprise, in the federal government,
6 and, in the case of the county sheriff’s salary, other
7 law enforcement personnel. The bill requires the county
8 compensation board to also consider the current economic
9 health of the county, state, and country when recommending the
10 compensation schedule.
11 The bill also requires the county compensation board
12 to provide documentation to the board of supervisors that
13 demonstrates how the county compensation board determined the
14 recommended compensation schedule, including by providing
15 the applicable compensation information for all the adjacent
16 counties in this state and for counties in this state with a
17 similar population.
