1 An Act relating to waiver of the placement investigations and
2 reports related to the adoption of a minor by a minor’s
3 legal guardian.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 600.8, Code 2023, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 7A. The juvenile court or court may waive
4 any investigation or report required under this section when
5 all of the following criteria are met:
6 a. The person to be adopted is a minor.
7 b. The adoption petitioner was appointed guardian of the
8 minor pursuant to chapter 232D at least three years prior to
9 the filing of the adoption petition.
10 c. The adoption petitioner has undergone the background
11 checks required pursuant to section 232D.307.
12 EXPLANATION
13 The inclusion of this explanation does not constitute agreement with
14 the explanation’s substance by the members of the general assembly.
15 This bill provides that preplacement and postplacement
16 investigations and reports generally required as part of
17 the adoption process may be waived by the juvenile court or
18 court when the person to be adopted is a minor, the adoption
19 petitioner was appointed guardian of the minor at least three
20 years prior to the filing of the adoption petition, and the
21 adoption petitioner has undergone criminal record checks and
22 checks of the child abuse, dependent adult abuse, and sex
23 offender registries in the state as required for all minor
24 guardianships.
