1 An Act relating to family-focused substance use disorder
2 treatment and programming, and making an appropriation.

1 Section 1. FAMILY-FOCUSED SUBSTANCE USE DISORDER TREATMENT
2 AND PROGRAMMING —— APPROPRIATION.
3 1. The department of health and human services shall
4 create a family-focused substance use disorder treatment and
5 programming grant program to provide grants to nonprofit
6 organizations that provide such treatment and programming
7 throughout the state. The department shall adopt rules
8 pursuant to chapter 17A to administer the program including
9 but not limited to rules regarding requirements for eligible
10 programs, grant applications, any licensing requirements
11 applicable to eligible programs, matching fund requirements,
12 and the duration and maximum amount of a grant.
13 2. To be eligible for a grant, a nonprofit organization
14 shall secure the commitment of a local government to provide
15 matching funds of one dollar to every two dollars of state
16 funding provided for the grant. A local government that
17 receives opioid settlement funds directly as a result of
18 a national settlement of litigation with entities that
19 manufactured, marketed, sold, distributed, dispensed, or
20 promoted opioids, made in connection with claims arising
21 from the manufacturing, marketing, selling, distributing,
22 dispensing, or promoting of opioids, may use such funds as the
23 match of state funds for a grant.
24 3. For the purposes of this section:
25 a. “Family-focused substance use disorder treatment and
26 programming” includes programs that afford the opportunity
27 for a person with a substance use disorder to recover in an
28 environment that meets the person’s needs by including children
29 and other family members in the treatment process, providing
30 family-based clinical care, and providing supportive and
31 community-based services including child care, transportation,
32 home visiting, mental health services, a medical home,
33 employment training, housing, ongoing support, and linkages to
34 other financial aid and human services programs, specific to
35 the person.

1 b. “Local government” includes a county, city, or other
2 local government entity within the geographic boundaries of the
3 state.
4 4. There is appropriated from the opioid settlement fund
5 created in section 12.51 to the department of health and human
6 services for the fiscal year beginning July 1, 2023, and ending
7 June 30, 2024, the following amount, or so much thereof as is
8 necessary, to be used for the family-focused substance use
9 disorder treatment and programming grant program as described
10 in this section:

12 Notwithstanding section 8.33, moneys appropriated in this
13 section that remain unencumbered or unobligated at the close of
14 the fiscal year shall not revert but shall remain available for
15 expenditure for the purposes designated until the close of the
16 succeeding fiscal year.
17 EXPLANATION
18 The inclusion of this explanation does not constitute agreement with
19 the explanation’s substance by the members of the general assembly.
20 This bill requires the department of health and human
21 services (HHS) to create a family-focused substance use
22 disorder treatment and programming grant program to provide
23 grants to nonprofit organizations that provide such treatment
24 and programming. The department shall adopt administrative
25 rules to administer the program. To be eligible for a grant, a
26 nonprofit organization shall secure the commitment of a local
27 government to provide a 2:1 match of local funds to state
28 funds for the grant. A local government that receives opioid
29 settlement funds directly as a result of a national settlement
30 may use the funds as the match of state funds for a grant.
31 The bill defines the terms “family-focused substance use
32 disorder treatment and programming” and “local government” for
33 the purposes of the bill.
34 The bill appropriates $2 million from the opioid settlement
35 fund created in Code section 12.51 to HHS for FY 2023-2024 to

1 be used for the family-focused substance use disorder treatment
2 and programming grant program. Moneys appropriated that remain
3 unencumbered or unobligated at the close of the fiscal year
4 shall not revert but shall remain available for expenditure
5 for the purposes designated until the close of the succeeding
6 fiscal year.
