1 An Act relating to livestock health, by providing for the
2 livestock health advisory council and livestock disease
3 research fund.

1 Section 1. Section 267.1, Code 2023, is amended by striking
2 the section and inserting in lieu thereof the following:
3 267.1 Definitions.
4 As used in this chapter, unless the context otherwise
5 requires:
6 1. “College of veterinary medicine” means the Iowa state
7 university of science and technology college of veterinary
8 medicine.
9 2. “Council” means the livestock health advisory council
10 created pursuant to section 267.2.
11 3. “Fund” means the livestock disease research fund created
12 in section 267.8.
13 4. “Livestock” means the same as defined in section 717.1.
14 5. “Member organization” means an organization appointing
15 one or more members to the council pursuant to sections 267.2
16 and 267.3.
17 6. “Producer” means a person engaged in the business of
18 producing livestock for profit.
19 Sec. 2. Section 267.2, Code 2023, is amended to read as
20 follows:
21 267.2 Livestock health advisory council creation and
22 membership.
23 1. There is a A livestock health advisory council, referred
24 to in this chapter as the council is created to support
25 research of livestock diseases conducted by the college of
26 veterinary medicine.
27 2. The council shall consist of all of the following:
28 1. a. Three cattle producers appointed by the Iowa
29 cattlemen’s association, one of whom shall serve an initial
30 term of one year, and one of whom shall serve an initial term
31 of two years.
32 2. b. Three swine producers appointed by the Iowa pork
33 producers association, one of whom shall serve an initial term
34 of one year.
35 3. c. One sheep producer appointed by the Iowa sheep

1 producers association who shall serve an initial term of one
2 year.
3 4. d. One poultry producer appointed by the Iowa north
4 central poultry association who shall serve an initial term of
5 two years.
6 e. One turkey producer appointed by the Iowa turkey
7 federation who shall serve an initial term of three years.
8 5. f. One milk producer appointed by the Iowa state dairy
9 association who shall serve an initial term of two years; and.
10 6. g. One practicing veterinarian appointed by the Iowa
11 veterinary medical association.
12 Sec. 3. Section 267.3, Code 2023, is amended to read as
13 follows:
14 267.3 Terms and vacancies —— expenses and compensation
15 prohibited.
16 1. Except as provided in section 267.2, each member of
17 the council shall be appointed by a member organization for a
18 three-year term beginning on July 1 of the year of appointment.
19 No A member shall not serve more than two terms, including any
20 portion of a term served pursuant to the filling of a vacancy.
21 Vacancies A vacancy shall be filled by the appropriate member
22 organization in the same manner as appointing a full-term
23 members member.
24 2. A member of the council is not entitled to receive
25 expenses incurred in the discharge of the member’s duties
26 on the council. A member is also not entitled to receive
27 compensation as otherwise provided in section 7E.6.
28 Sec. 4. Section 267.5, Code 2023, is amended to read as
29 follows:
30 267.5 Duties and objectives of council.
31 The livestock health advisory council shall do all of the
32 following:
33 1. Elect a chairperson and such other officers as it deems
34 advisable. Officers of the council shall serve for terms of

1 more than two terms.
2 2. Hold a meeting twice each year at Iowa state university
3 of science and technology. The council shall meet with the
4 Iowa state university faculty of the college of veterinary
5 medicine. Hold The council may hold other such meetings as
6 the council may determine necessary, or as required by section
7 267.6. No An action taken by the council shall not be valid
8 unless agreed to by a majority of the council members.
9 3. a. Make By the beginning of each fiscal year, make
10 recommendations to the Iowa state university college of
11 veterinary medicine concerning the application expenditure of
12 funds appropriated to the college of veterinary medicine moneys
13 in the fund.
14 b. The Iowa state university college of veterinary medicine
15 shall not expend any of the funds appropriated by this chapter
16 until the recommendation of the council concerning that
17 appropriation is adopted or sixty days following the effective
18 date of the appropriation, whichever is earlier The college of
19 veterinary medicine shall not obligate moneys in the fund for
20 a fiscal year until the council makes timely recommendations
21 for the expenditure of those moneys for that fiscal year as
22 required in paragraph “a”.
23 4. File an annual report with the secretary of agriculture.
24 Sec. 5. Section 267.7, Code 2023, is amended to read as
25 follows:
26 267.7 Other funds moneys.
27 In addition to the funds appropriated to it by this chapter
28 moneys in the fund, the Iowa state university college of
29 veterinary medicine may accept grants, gifts, matching funds
30 moneys, or any other funds moneys for research into the
31 diseases of affecting livestock. The moneys may be from any
32 source, public or private.
33 Sec. 6. Section 267.8, Code 2023, is amended to read as
34 follows:
35 267.8 Livestock disease research fund.

1 There is created in the office of the treasurer of state
2 a fund to be known as the livestock disease research fund.
3 Moneys in the fund are appropriated for use by the college of
4 veterinary medicine to conduct research of diseases affecting
5 livestock. Any balance in said fund on June 30 of each fiscal
6 year shall revert to the general fund.
7 Sec. 7. REPEAL. Section 267.4, Code 2023, is repealed.
8 EXPLANATION
9 The inclusion of this explanation does not constitute agreement with
10 the explanation’s substance by the members of the general assembly.
11 BACKGROUND. This bill amends provisions in Code chapter
12 267 which establishes and provides for the administration of
13 the livestock health advisory council (council) which meets
14 twice each year and provides recommendations to the Iowa state
15 university of science and technology’s college of veterinary
16 medicine (college). The board includes members appointed by
17 organizations of livestock producers (member organizations),
18 including cattle, swine, sheep, poultry, and milk. One
19 member is a practicing member of the Iowa veterinary medical
20 association. The college’s research into diseases affecting
21 livestock is supported by the livestock disease research fund
22 (fund) which may be appropriated moneys by the general assembly
23 (see, e.g., 2022 Iowa Acts, chapter 1147, section 22).
24 BILL’S PROVISIONS. The bill changes the name of the member
25 organization appointing a poultry producer and adds a member
26 organization appointing a turkey producer. The bill provides
27 that the council is to meet at Iowa state university rather
28 than the department of agriculture and land stewardship. A
29 member is not entitled to receive compensation or expenses.
30 The purpose of the council is to support research of livestock
31 diseases, and it must make its recommendations to the college
32 by the first day of the fiscal year (July 1 through June 30).
33 The college is expressly authorized to use moneys in the fund
34 to conduct research of diseases affecting livestock.
