1 An Act relating to moneys credited to the flood mitigation
2 fund from fees collected for flying our colors registration
3 plates.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 321.34, subsection 11D, paragraph c,
2 subparagraph (2), Code 2023, is amended to read as follows:
3 (2) The treasurer of state shall credit monthly from the
4 statutory allocations fund created under section 321.145,
5 subsection 2, to the flood mitigation fund created under
6 section 418.10, the amount of the special fees collected in the
7 previous month for flying our colors plates. This subparagraph
8 is repealed July 1, 2023.
9 EXPLANATION
10 The inclusion of this explanation does not constitute agreement with
11 the explanation’s substance by the members of the general assembly.
12 Under current law, upon application and payment of the
13 proper fees, a person may obtain flying our colors motor
14 vehicle registration plates. The special flying our colors
15 fee is $35 and the additional annual fee is $10. The fees
16 are deposited in the road use tax fund. The treasurer of
17 state is then required to credit monthly, from the statutory
18 allocations fund (SAF) to the flood mitigation fund (FMF), an
19 amount equal to the amount of the fees collected for flying our
20 colors plates. The SAF is established, in part, to transfer
21 and credit available moneys pursuant to Code section 321.34
22 as provided for the various purposes specified for special
23 registration plates.
24 The deposit of moneys from the SAF to the FMF for flying our
25 colors plates is set to be repealed July 1, 2023. This bill
26 strikes the repeal.
