1 An Act relating to persons authorized to receive a copy of a
2 written accident report filed by a law enforcement officer.

1 Section 1. Section 321.271, subsection 2, Code 2023, is
2 amended to read as follows:
3 2. All written reports filed by a law enforcement officer
4 as required under section 321.266 shall be made available to
5 any party to an accident, the party’s insurance company or
6 its agent, the party’s attorney, the federal motor carrier
7 safety administration, or the attorney general, on written
8 request to the department and the payment of a fee of four
9 dollars for each copy. If a copy of an investigating officer’s
10 report of a motor vehicle accident filed with the department
11 is retained by the law enforcement agency of the officer
12 who filed the report, a copy shall be made available to any
13 party to the accident, the party’s insurance company or its
14 agent, the party’s attorney, the federal motor carrier safety
15 administration, other law enforcement agencies, or the attorney
16 general, on written request and the payment of a fee. However,
17 the attorney general and the federal motor carrier safety
18 administration shall not be required by the department or the
19 law enforcement agency to pay a fee for a copy of a report filed
20 by a law enforcement or investigating officer.
21 EXPLANATION
22 The inclusion of this explanation does not constitute agreement with
23 the explanation’s substance by the members of the general assembly.
24 This bill authorizes a copy of a written report that
25 was filed with the department of transportation by a law
26 enforcement officer who investigated a motor vehicle accident
27 which resulted in injury to or death of any person or total
28 property damage to an apparent extent of $1,500 or more, and
29 that was retained by the agency of the officer who filed the
30 report, to be made available to other law enforcement agencies.
31 The bill does not apply this authorization to such reports that
32 were not retained by the agency of the officer.
33 Under current law, a person eligible to receive a copy of
34 the report, other than the attorney general or federal motor
35 carrier safety administration, must make a written request and

1 pay a fee, including other law enforcement agencies authorized
2 under the bill.
