1 An Act relating to voter records created and retained by the
2 state commissioner of elections and county commissioners of
3 elections.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. NEW SECTION. 49.106 Records preserved.
2 1. At the conclusion of each election, the state
3 commissioner of elections shall create a record containing all
4 information in the statewide voter registration database at the
5 time of the election for each voter who voted in the election.
6 The state commissioner of elections shall maintain this record
7 for twenty-two months.
8 2. A record created pursuant to this section shall be made
9 available in an electronic format at no cost upon request,
10 except that if the record is too large to be transmitted
11 electronically, the requester shall provide a device to store
12 the record.
13 Sec. 2. NEW SECTION. 52.39 Ballot logs.
14 1. Each commissioner shall create a log of each vote cast in
15 the county for each primary and general election, which must be
16 in the form of a text, comma, or tab delimited file organized
17 in the order in which ballots were processed. The log must
18 include all of the following information for each ballot cast
19 in the county, if available:
20 a. The sequential identification number.
21 b. The timestamp.
22 c. The method by which the ballot was cast.
23 d. The candidates for whom the ballot was marked.
24 e. Batch identification number.
25 f. Tabulator identification number.
26 2. A log created pursuant to this section shall not include
27 personally identifiable information for any ballot, including a
28 voter’s name, voter identification number, or address.
29 3. To the extent possible, data in the log shall be made
30 available on a per precinct basis.
31 4. A log created pursuant to this section shall be made
32 available in an electronic format at no cost upon request,
33 except that if the log is too large to be transmitted
34 electronically, the requester shall provide a device to store
35 the log.

1 5. A log created pursuant to this section shall be
2 maintained for twenty-two months after the election for which
3 the log was created.
4 6. The state commissioner of elections shall adopt rules
5 pursuant to chapter 17A to implement this section.
6 EXPLANATION
7 The inclusion of this explanation does not constitute agreement with
8 the explanation’s substance by the members of the general assembly.
9 This bill relates to records created and retained by the
10 state commissioner of elections and county commissioners
11 of elections. The bill requires the state commissioner of
12 elections to create a record containing all information in
13 the statewide voter registration database at the time of an
14 election for each voter who voted in that election. The state
15 commissioner of elections shall maintain the record for 22
16 months. A person may request an electronic copy of the record
17 at no cost.
18 The bill also requires each county commissioner of elections
19 to create a log of each ballot cast at each primary and general
20 election in the form of a text, comma, or tab delimited file.
21 The log must include, to the extent possible, each ballot’s
22 sequential identification number, timestamp, method of voting,
23 selection of candidates, batch identification number, and
24 tabulator identification number. The log shall not include
25 any personally identifiable information for a voter. The bill
26 requires the data in the log to be made available on a per
27 precinct basis if possible. A person may request an electronic
28 copy of a log at no cost, and a log shall be maintained for 22
29 months following the election for which the log was created.
