1 An Act relating to the waiting period for a replacement of a
2 motor vehicle certificate of title.

1 Section 1. Section 321.42, subsection 2, paragraph b, Code
2 2023, is amended to read as follows:
3 b. After five days, the The department or county treasurer
4 shall issue a replacement copy using the applicant’s most
5 recent bona fide address; however, the five-day waiting period
6 does not apply to an applicant who is a lienholder or to an
7 applicant who has surrendered the original certificate of
8 title to the department or county treasurer. The replacement
9 copy shall be clearly marked “replacement” and shall include
10 security interests and liens. When a replacement copy has been
11 issued, the previous certificate is void. The department or
12 county treasurer is not authorized to refund fees collected for
13 a replacement title under this section or section 321.52A.
14 EXPLANATION
15 The inclusion of this explanation does not constitute agreement with
16 the explanation’s substance by the members of the general assembly.
17 Under current law, if an original certificate of title to
18 a motor vehicle is lost or destroyed, the owner or lienholder
19 is required to apply for a replacement copy. The application
20 must be made to the department of transportation (DOT) or
21 county treasurer who issued the original certificate of title.
22 The application must be signed by the owner or lienholder
23 and accompanied by a $20 fee. The DOT or county treasurer
24 must wait five days before issuing a replacement copy using
25 the applicant’s most recent bona fide address. However, the
26 five-day waiting period does not apply to an applicant who is a
27 lienholder or to an applicant who has surrendered the original
28 certificate of title to the DOT or county treasurer.
29 This bill strikes the five-day waiting period.
