1 Section 1. Section 692.1, subsection 7, Code 2023, is
2 amended to read as follows:
3 7. “Criminal or juvenile justice agency” means an agency
4 or department of any level of government or an entity wholly
5 owned, financed, or controlled by one or more such agencies
6 or departments, or a federally recognized Indian tribe,
7 which performs as its principal function the apprehension,
8 prosecution, adjudication, incarceration, or rehabilitation of
9 criminal or juvenile offenders.
10 EXPLANATION
11 The inclusion of this explanation does not constitute agreement with
12 the explanation’s substance by the members of the general assembly.
13 This bill relates to criminal history and intelligence data.
14 The bill provides that a “criminal or juvenile justice
15 agency” includes a federally recognized Indian tribe
16 which performs as its principal function the apprehension,
17 prosecution, adjudication, incarceration, or rehabilitation
18 of criminal or juvenile offenders. Under current law, the
19 department of public safety may provide copies or communicate
20 information from criminal history data to a criminal or
21 juvenile justice agency. Criminal history data includes data
22 concerning arrests, convictions, dispositions, corrections,
23 adjudications, and custody.
