1 An Act authorizing school districts, accredited nonpublic
2 schools, and charter schools to pay stipends to student
3 teachers.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 256E.7, subsection 4, Code 2023, is
2 amended by adding the following new paragraph:
3 NEW PARAGRAPH. c. A charter school may pay a stipend
4 to a student who is fulfilling the requirements associated
5 with the student teaching experience established pursuant to
6 section 256.16, subsection 1, paragraph “c”, at the charter
7 school in an amount not more than the lowest annual salary the
8 charter school governing board pays to a teacher employed by
9 the charter school, prorated to the number of days the student
10 is present at the charter school during the student teaching
11 experience.
12 Sec. 2. NEW SECTION. 280.33 Student teachers —— stipends.
13 The board of directors of a school district and the
14 authorities in charge of an accredited nonpublic school may
15 pay a stipend to a student who is fulfilling the requirements
16 associated with the student teaching experience established
17 pursuant to section 256.16, subsection 1, paragraph “c”, at the
18 school district or accredited nonpublic school in an amount
19 not more than the lowest annual salary the board of directors
20 of the school district or the authorities in charge of the
21 accredited nonpublic school pays to a teacher employed by the
22 school district or accredited nonpublic school, prorated to the
23 number of days the student is present at the school district
24 or accredited nonpublic school during the student teaching
25 experience.
26 Sec. 3. Section 294.1, Code 2023, is amended to read as
27 follows:
28 294.1 Qualifications —— compensation prohibited —— student
29 teacher stipends.
30 1. a. A person shall not be employed as a teacher in
31 a public or accredited nonpublic school without having a
32 certificate issued by some officer duly authorized by law.
33 2. b. Compensation shall not be recovered by a teacher for
34 services rendered while without such certificate.
35 2. Notwithstanding subsection 1, a public school,

1 accredited nonpublic school, or charter school may pay a
2 stipend to a student who is fulfilling the requirements
3 associated with the student teaching experience established
4 pursuant to section 256.16, subsection 1, paragraph “c”.
5 EXPLANATION
6 The inclusion of this explanation does not constitute agreement with
7 the explanation’s substance by the members of the general assembly.
8 This bill authorizes school districts, accredited nonpublic
9 schools, and charter schools to pay stipends to student
10 teachers. The bill limits the amount of the stipend to an
11 amount not more than the lowest annual salary the school pays
12 to a teacher employed by the school, prorated to the number of
13 days the student is present at the school during the student
14 teaching experience. The bill makes conforming changes to
15 Code section 294.1 (teacher qualifications and compensation
16 prohibitions).
