AN ACT
RELATING TO A STATE-FUNDED PSYCHIATRY RESIDENCY AND FELLOWSHIP
PROGRAM.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 135.180, Code 2023, is amended to read
2 as follows:
3 135.180 State-funded psychiatry residency and fellowship
4 program —— fund —— appropriations.
5 1. a. The university of Iowa hospitals and clinics shall
6 administer a state-funded psychiatry residency and fellowship
7 program in cooperation for up to nine residents and up to
8 two fellows, annually. The university of Iowa hospitals and
9 clinics shall expand the psychiatry residency program to
10 provide additional residency positions by providing financial
11 support for residency positions which are in excess of the
12 federal residency cap established by the federal Balanced
13 Budget Act of 1997, Pub. L. No. 105-33.
14 b. The university of Iowa hospitals and clinics shall
15 cooperate with the state mental health institutes at
16 Independence and Cherokee, the state resource center at
17 Woodward, the state training school at Eldora, and the Iowa
18 medical and classification center at Oakdale in administering
19 the program. The university of Iowa hospitals and clinics
20 shall expand the psychiatry residency program to provide
21 additional residency positions by providing financial support
22 for residency positions which are in excess of the federal

23 residency cap established by the federal Balanced Budget Act of
24 1997, Pub. L. No. 105-33. Participating residents and fellows
25 shall complete a portion of their psychiatry training at one
26 of the state mental health institutes, the state resource
27 center, the state training school, or the Iowa medical and
28 classification center at Oakdale. For accreditation-required
29 clinical experiences not available at the state mental health
30 institutes, the state resource center, the state training
31 school, or the Iowa medical and classification center at
32 Oakdale, the residents of the psychiatry residency and
33 fellowship program and its residents may utilize clinical
34 rotations at the university of Iowa hospitals and clinics and
35 its affiliates across the state.
1 2. The university of Iowa hospitals and clinics shall apply
2 to the accreditation council for graduate medical education
3 for approval of twelve nine additional residency positions
4 for each class of residents and the psychiatry residency and
5 fellowship program shall award the total number of residency
6 positions approved for each class of residents. The university
7 of Iowa hospitals and clinics shall approve and award up to two
8 fellowship positions annually. Preference in the awarding of
9 residency and fellowship positions shall be given to candidates
10 who are residents of Iowa, attended and earned an undergraduate
11 degree from an Iowa college or university, or attended and
12 earned a medical degree from a medical school in Iowa.
13 3. A psychiatry residency and fellowship program fund
14 is created in the state treasury consisting of the moneys
15 appropriated or credited to the fund by law. Notwithstanding
16 section 8.33, moneys in the fund at the end of each fiscal year
17 shall not revert to any other fund but shall remain in the
18 psychiatry residency and fellowship program fund for use in
19 subsequent fiscal years. Moneys in the fund are appropriated
20 to the university of Iowa hospitals and clinics to be used for
21 the purposes of the program. For the fiscal years beginning on
22 or after July 1, 2023, there is appropriated from the general
23 fund of the state to the psychiatry residency and fellowship
24 program fund one hundred thousand dollars for each residency
25 position approved and awarded under the program and one hundred

26 fifty thousand dollars for each fellowship position approved
27 and awarded under the program.
