A BILL FOR
1 An Act prohibiting a county or city from adopting, enforcing,
2 or administering legislation specific to the breed or
3 physical characteristics of a dog.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 Section 1. Section 331.301, Code 2023, is amended by adding
2 the following new subsection:
3 NEW SUBSECTION. 22. A county shall not adopt, enforce,
4 or otherwise administer an ordinance, motion, resolution,
5 or amendment that is specific to the breed or physical
6 characteristics of a dog. This subsection does not inhibit
7 the authority of a county to adopt, enforce, or administer an
8 ordinance, motion, resolution, or amendment that applies to all
9 dogs.
10 Sec. 2. Section 364.3, Code 2023, is amended by adding the
11 following new subsection:
12 NEW SUBSECTION. 18. A city shall not adopt, enforce,
13 or otherwise administer an ordinance, motion, resolution,
14 or amendment that is specific to the breed or physical
15 characteristics of a dog. This subsection does not inhibit
16 the authority of a city to adopt, enforce, or administer an
17 ordinance, motion, resolution, or amendment that applies to all
18 dogs.
19 EXPLANATION
20 The inclusion of this explanation does not constitute agreement with
21 the explanation’s substance by the members of the general assembly.
22 This bill prohibits counties and cities from adopting,
23 enforcing, or administering an ordinance, motion, resolution,
24 or amendment specific to the breed or physical characteristics
25 of a dog. The bill does not inhibit the authority of a county
26 or city to adopt, enforce, or administer an ordinance, motion,
27 resolution, or amendment that applies to all dogs.
